4–13. Terms and Safety Rules
Eligibility Requirements
- Renter is at least 18 years old.
- Renter possesses all required licenses/certifications.
- Renter is physically and mentally capable of safely operating the Jet Ski.
- Renter is not under the influence of alcohol or drugs.
Safety Rules
- Wear a U.S. Coast Guard-approved life jacket at all times.
- Follow all instructions and applicable laws.
- Remain within designated riding areas.
- Report accidents or mechanical issues immediately.
Prohibited Activities
- Operating under the influence.
- Reckless operation, racing, or stunts.
- Unauthorized operators.
- Operating outside approved areas.
Responsibility for Damage: Renter accepts responsibility for damage, theft, towing, recovery, repair, and replacement costs.
Assumption of Risk: Renter understands and voluntarily assumes all risks associated with Jet Ski operation, including injury, drowning, property damage, paralysis, and death.
Release of Liability: Renter releases the Rental Company and its owners, employees, and agents from claims arising from the rental and use of the Jet Ski, including claims based on ordinary negligence to the fullest extent permitted by Florida law.
Indemnification: Renter agrees to defend, indemnify, and hold harmless the Rental Company from claims, damages, losses, and expenses arising from use of the Jet Ski.
Medical Authorization: Renter authorizes emergency medical treatment if necessary and accepts responsibility for all related costs.
Accident Reporting: Renter agrees to immediately report accidents, injuries, property damage, or law enforcement contact.
15–17. Governing Law, Severability, and Acknowledgment
Governing Law: This Agreement shall be governed by the laws of the State of Florida.
Severability: If any provision is unenforceable, the remaining provisions remain in effect.
Acknowledgment: By signing below, Renter acknowledges reading, understanding, and voluntarily agreeing to this Agreement.
